• visit our Platform; or

TRAINING BUYER” means the individual or organisation that buys training services via the Company’s platform.

TRAINING PROVIDER” means the individual or organisation that offers or provides training services via the Company’s platform.

"LEARNER"  means the named person for whom a Training Provider has agreed to provide a Training Service

Collection of Personal Data

When you interact with us or out Platform, we may collect Personal Data. Sometimes this will be on our own behalf, and other times this will be on behalf of a Training Provider using our Services. 
We do not collect more information than we need to deliver our stated services and will not retain it for longer than is necessary. Whenever you give us your data data, you are consenting to its collection and use in accordance with this policy.
As a Training Buyer, you are able to discover the Training Services and Training Providers on our Platform without providing any Personal Data. If you choose not to provide any Personal Data or limit the Personal Data you provide, you will not be able to book a Training.
As a Training Provider, it is required that you provide Personal Data in order to be able to list a Training Service.
The Personal Data that may be collected on the website and stored includes:
• Personal details: Name, email address, phone number, street address
• Account details: username, password (stored in encrypted format)
• The description text that the user may write about him/herself
• The offers and requests the user has posted to the service
• The given and received feedback and badges
• Statistical data about service usage, e.g. number times the user has logged in

Information you provide to us.

We collect personal information from you:
• through the use of forms, which may be on paper or on our Website, such as when you login to access our Services, signup to receive our newsletters, register for information, make a booking, or pay for a training service;
• when you create an account and provide us with information about you, your requirements, the services you provide, or any other information that we may use to provide our Services;
• when you communicate with us or with other Users for any reason, including by direct messaging, email, or telephone, and when you use our Website.
If you are a Training Provider, we will collect additional Financial Information from you (e.g., your bank account information)

Information you provide to other Users.

This Privacy Policy does not apply to any Personal Data that you provide to another User (including, but not limited, to Training Providers during the delivery of a Training Service) through the Platform (or through any other means).

Information that we collect automatically.

When you visit our Website, we may collect certain information automatically from your device (e.g., your IP address, device type, unique device identification numbers, broad geographic location and other technical information). We may also collect information about how your device has interacted with our Website, including the pages accessed and links clicked. Some of this information may be collected using cookies and similar tracking technology. We use this information for our internal analytics purposes and to improve the quality and relevance of our Services.
You can create a Trainingbrite account and log in your Trainingbrite account using third party services (such as LinkedIn), in which case we may collect, use, disclose, transfer and retain information relating to your account with such third-party services in accordance with this Privacy Policy.

Information we obtain from third party sources.

We may receive personal information about you from third party sources (for example when somebody else enrols you on a course or creates an account on your behalf), but only where we believe that these third parties have your consent. We collect only the minimum amount of information required from these third parties to enable us to provide the requested service. We only use the information we receive from these third parties as set out in this Privacy Notice.

Information you provide on behalf of third parties.

If You are providing data to us that is not personal to You, You agree that You have the data owner’s permission to do so, as required by applicable law, for us to: (a) use or disclose the data in accordance with our Privacy Policy, (b) move the data outside of the country of residence of such owner of the personal data, if applicable, (c) provide the data to third parties, and (d) otherwise use and disclose the data in accordance with this Agreement. 

Use of your personal data.

We use your personal data:
• to provide services to you or your organisation
• for basic profiling purposes
• to let you know about other services in which you may be interested
• to inform you about changes and improvements to this website
The information that we collect and store relating to you is primarily used to enable us and Training Providers to provide Training Services to you. In addition, we may use the information for the following purposes:
• to provide you with information or Training Services you requested;
• to provide information on other Training Services which we feel may be of interest to you, in accordance with your communications and consent preferences;
• to meet our contractual commitments to you;
• to act on your behalf where third-party involvement is available and appropriate – for example through a Training Provider or certification/awarding body;
• to monitor and analyse trends, usage and activities in connection with our Platform and Services; and
• as necessary to prevent or detect crime or any other activity that may be in breach of our Terms of Use.

Trainingbrite Marketing Communications. 

Trainingbrite may send you electronic communications marketing or advertising Training Services, to the extent you have created an Account or purchased a Training Service. You can "opt out" of receiving these electronic communications by managing your notification preferences at any time by logging in, clicking on "Profile", then “Edit Profile”, and then "Notifications".

Training Providers Marketing Communications. 

Provided they use their own email subscription lists, users of our Platform may use our email tools to invite prospective Training Providers or Training Buyers to access our Platform. Although these communications are sent through our system, Trainingbrite does not have any control of the content, nor of the recipients of these communications. 
Trainingbrite is not responsible for the actions of Training Providers, or their Third Parties (or other downstream recipients of your Personal Data), with respect to your Personal Data. 

Storing and Retaining your personal data

Your personal information is stored within secure servers. We use appropriate technical and organisational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information.
Where we have given you (or where you have chosen) a password so that you can access certain parts of our Platform, you are responsible for keeping this password safe.
When we have no ongoing legitimate business need to process your personal information, we will delete it.

Disclosing your information

Trainingbrite does not sell, trade, or rent your personal information to others. 
We may have to transfer your personal data to a third party if they need it in order to fulfil your booking request or to support the delivery of Training Services. If we need to disclose your personal data to any other person for any other reason, we will ask first for your consent to the disclosure.
Except as set out above, we shall not disclose your personal information unless obliged to or allowed to do so by law, or where we need to in order to run our business. 

Data protection rights and Lawful basis (EEA, CH, AND UK ONLY)

Our lawful bases for collecting and using personal information is because:
• you provided your consent;
• it is necessary for our contractual relationship (for example, to enrol you into a course);
• it is necessary for us to comply with our legal or regulatory obligations; and/or
• it is in our legitimate interest as training services marketplace (for example to provide Users with customer service, make payments to Training Providers, etc.). 
If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our platform and communicating with you as necessary to provide our services to you and for our legitimate commercial interest, for instance, when responding to your queries, improving our platform, undertaking marketing, or for the purposes of detecting or preventing illegal activities. 
If you use the Platform as a Learner or a Training Buyer, we may need to transfer your Personal Data to a Training Provider from which you have purchased a Training Service using our Platform, as this is in our legitimate interest to enable the Training Provider to communicate with you in relation to the delivery of the Training Service. We will only do this if it is necessary, and will only provide the minimum information necessary to allow the Training Provider to contact Learners, typically your email address.
By the nature of the Internet, we may need to transfer your Personal Data to servers outside of the country from which it was originally provided, typically to third parties that we work with, to countries which may have no or less strict data protection laws. Whenever we transfer, store and process anywhere in the world Personal Data outside of the EEA, Switzerland or the UK, we will ensure that all reasonable measures are taken to protect it, and that any third-party supplier we use to deliver our services is GDPR compliant.

Your right to access, update, correct, or delete your personal data.

You can access, edit, or delete your Personal Data. If you are a User with an Account on our Platform, you can do this by logging in and editing your profile in your personal page.
If you wish to access, correct, update or request deletion of your personal information, and it is not possible to do so through the website, you can contact us using the “contact us” form on the website.
If we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
